Appeals Court Affirms Phelps Trial Win in Injury Lawsuit
The Kentucky Court of Appeals on Dec. 5 affirmed an earlier jury trial win for a Phelps client in a serious personal injury case resulting from a commercial vehicle crash.
In this case, Phelps helped a national medical diagnostic company defeat a mid-8 figure claim for allegedly devastating brain injuries by securing a jury trial win in August 2024 in Kentucky. The plaintiff and his five-lawyer team from a national trial firm alleged that he suffered a traumatic brain injury with major long-term cognitive deficits, resulting in an inability to run his previously successful business after an auto accident with his car and the client’s corporate delivery vehicle.
Phelps was able to compromise the credibility of the plaintiff and his numerous expert witnesses to convince the jury that plaintiff’s claims of serious injury lacked credibility. In a case of conceded fault, the jury awarded the plaintiff only a fraction of his claimed past medical expenses and awarded nothing at all for past and future pain and suffering.
