This is a discussion of how courts and the EEOC are increasingly willing to equate generally bad employee behavior with a violations of the law. Bullying is not recognized as a distinct cause of action under any federal statue; however, seventeen (17) states have considered legislation on workplace bullying, and federal courts routinely consider it as part of an overall pattern of harassment, discrimination or retaliation. There will be a discussion of recent cases.
