    Clerc Cooper represents public and private employers though all stages of employment disputes, from providing initial guidance, responding to agency and administrative charges and investigations, through litigation and appeal. She has experience defending employers in cases involving:

    • Discrimination
    • Employee misclassification
    • Family and medical leave
    • Restrictive covenants
    • Retaliation
    • Trade secrets
    • Wage and hour issues

    She also regularly advises employers on compliance with various labor and employment laws including the preparation and review of employment contracts, restrictive covenants, severance agreements, and employee handbooks and policies, as well as providing guidance on employee classification.

    Clerc has experience on both sides of litigation involving alleged theft of trade secrets by former employees. She has also practiced before the World Intellectual Property Organization to successfully defend the use of domain names.

    Prior to joining Phelps, Clerc clerked for the Hon. Susie Morgan in the U.S. District Court for the Eastern District of Louisiana and the Hon. Jacques L. Wiener Jr. in the U.S. Court of Appeals for the Fifth Circuit. While in law school, Clerc was a managing editor for the Tulane Law Review as well as a member of The Order of the Coif.

    • Secured termination of EEOC investigation without finding of liability for employer against discrimination, harassment and retaliation charges.
    • Obtained early dismissal for insurance agents and brokers in case involving alleged negligence obtaining coverage for COVID-19-related issues.
