    David McGee is a venerated, white collar defense attorney. His 50-year practice spans public service as an Assistant U.S. Attorney and private representation of individuals, professionals and corporations in high-risk, complex disputes and litigation. Dave negotiates, tries and resolves qui tam whistleblower, RICO and False Claims Act actions and claims of medical billing fraud, money laundering, and securities violations.

    Dave easily navigates the court of public opinion. Many clients are prominent people or entities, and their cases attract publicity worldwide. His discreet and efficient handling of matters protects the reputations and livelihoods of executives and professionals in health care, financial services, construction and other fields. Dave has negotiated and interacted with nearly every major U.S. government agency and has sued foreign terrorist nations.

    A self-described old-school, meticulously prepared trial lawyer with a big courtroom presence, Dave skillfully manages parallel civil and criminal enforcements. He draws from his early career with the U.S. Department of Justice, which includes leading a task force on organized crime, to guide and safeguard clients in the government’s crosshairs.

    Dave’s professional leadership includes longtime service on the board of the C. Roger Vinson American Inn of Court Pensacola Chapter.

    Experience

    • Represented hospital in qui tam federal investigation for billing allegations. Made presentations to the U.S. Attorney and FBI, resulting in the government declining intervention and dismissal of action.
    • Defended physician on 61 counts of federal health care fraud and violations of the Controlled Substances Act in the Northern District of Florida. Government dismissed all fraud counts prior to trial in response to pre-trial motions. Jury returned not guilty verdict on all remaining counts.
    • Obtained favorable jury verdict in a RICO lawsuit on behalf of prominent New York investors against a bank and involving more than $20M in losses in a Florida land scam.
    • Achieved dismissal of a DOJ Bivens action against a Federal Bureau of Prison official accused of violating the constitutional rights of a prisoner.
    • Resolved disputes in defense of a contractor involving claims of engineering malpractice and defective products in an airport construction project.
    • Obtained record-setting damage award in federal judge’s ruling holding Iran accountable for terrorist action against U.S. citizen.
