    Phelps Dunbar's Health Care Litigation practice includes attorneys from numerous practice areas at the firm that represent industry clients throughout the region, on a national basis and on a statewide basis where the firm has offices. Attorneys in the practice represent hospitals, nursing home facilities, physicians and physician groups, rehab centers, long-term care facilities, managed care companies, ambulatory surgery centers, and health care personnel staffing companies. In addition, the firm represents insurance companies for health care facilities, medical transportation companies, and pharmaceutical manufacturers.

    Much of the practice focuses on facility defense for malpractice and liability claims. These types of cases typically involve nursing homes, rehab facilities and hospitals and are handled from the medical review panel process through litigation.

    In addition, the group has handled litigation matters including exclusive dealing contracts, breach of contract, most favored nations clauses, FTC/DOJ investigations, antitrust counseling on organizational structure and practices, fee negotiations, staff privilege/bylaws disputes, and claims of unreasonable restraints of trade, monopolization, and unfair trade. Attorneys in the practice also have experience in dealing with health care fraud issues and have handled certificate of need litigation cases for MRI facilities, ambulatory surgery centers and medical office buildings.

    In the area of pharmaceutical litigation, the firm has represented clients involving birth defects, claims of autism and related problems allegedly caused by the use of certain childhood vaccines, and diet supplement manufacturers in suits contending that products containing ephedra resulted in strokes and other serious injuries, to name a few.

    Our practice draws from the resources of a regional firm, which includes a full-service health care regulatory practice that represents large hospitals and health care providers and the experience of an on-staff nurse-paralegal.
