    Lucy Porter helps businesses protect their information while following state, federal and international laws. Using her skill at explaining complex legal concepts in plain language, she advises clients across all industries—including energy, health care, financial institutions and real estate—in developing and implementing compliance programs in the rapidly changing areas of data privacy, cloud computing and artificial intelligence (AI). Her tremendous experience extends to counseling clients on data protection, use and sharing requirements, confidentiality and user obligations in the event of a data breach.

    As a business lawyer, Lucy also helps clients find a tailored solution or approach to their technology needs. She prepares and negotiates contracts for procuring technology goods and services related to:

    • AI tools
    • Cloud offerings
    • IT professional services and outsourced/managed services
    • Traditional software

    In addition, Lucy helps clients protect their intellectual property assets. As a registered patent lawyer, she counsels them through the development, protection and licensing of intellectual property, and the purchase and sale of assets that include intellectual property. She also performs due diligence reviews and prepares agreements to record the transfer of intellectual property in connection with such commercial transactions.

    Experience

    • Developed website policies for consistent implementation across multiple business lines that comply with the California Consumer Privacy Act (CCPA), General Data Protection Regulation (GDPR), Telephone Consumer Protection Regulation (TCPA), and other state, federal and international laws for a multi-national real estate firm.
    • Reviewed a distribution agreement and advised a chemical manufacturer on complying with data privacy regulations in Texas, Europe and the United Kingdom.
    • Advised on requirements for compliance with Telephone Consumer Protection Act (TCPA) and Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003 (CAN-SPAM) prior to the release of consumer tools for a compounding pharmacy.
    • Negotiated contracts for the licensing and implementation of an AI-enabled video monitoring system for a manufacturer in the automotive industry.
    • Provided analysis and guidance of the applicability of the General Data Protection Regulation and other international privacy laws on contracts with third- party vendors for a U.S.-based public utility.
    • Guided the negotiation of a data processing agreement with a UK-based vendor as part of an outsourcing transaction for a health care company.
    • Negotiated a cloud-based ERP licensing agreement and implementation services agreement, with different providers, on behalf of a renewable energy company.
