    Steve Levine practices in the area of litigation with a focus on environmental counseling. He has wide experience in environmental litigation arising from enforcement, toxic tort and business-related claims. As a significant part of these engagements, he works closely with experts in a variety of professional fields. He routinely interacts with the Environmental Protection Agency in several regions and state environmental regulatory agencies in several states in matters relating to litigation, permitting, compliance orders and penalty orders. Additionally, he counsels lending and real estate institutions on such matters as environmental assessments, contractual arrangements and wetlands issues.

    Steve’s practice serves the petrochemical industry, the transportation industry, the banking and real estate sectors, the power generation sector and other industry business sectors.

    Before entering law school, he gained substantive educational and practical experience in the areas of fisheries biology, water resources, conservation and resource management.

    Experience

    • Toxic tort litigation and environmental regulatory work involving PCB and chlorinated solvent impacts in Mississippi.
    • Toxic tort litigation and environmental regulatory work involving claims against landfills in the Florida Panhandle.
    • Defense of environmental consulting companies in Ohio, Florida, and Louisiana.
    • Multimedia assessment and remediation work at sites in Ohio, Kansas, Texas, Pennsylvania, North Carolina, Louisiana, Alabama, Mississippi, Florida, California, Indiana, Wyoming, Maryland, and Kentucky.
    • Counseling and consultation on claims arising from contamination of fuel oil with PCBs in the Mid-Atlantic area.
    • Information-based interface with EPA on Superfund sites in North Carolina and Pennsylvania.
    • Defense of oil field legacy cases in Louisiana.
    • Representation of wind energy developers with projects across the Gulf South.
    • Defense of railroad against claims arising from train derailment in Plaquemine, Louisiana.
    • Representing interests of insurer in OPA reimbursement claims against U.S. Coast Guard.
    • Cost recovery suit under several environmental and other theories tried before judge and jury in Middle District of Louisiana.
    • Representation of the defendant in a federal civil penalty case brought by U.S. Department of Justice for EPA against facility located in Ville Platte, Louisiana over NPDES permitting issues.
    • Representation of parish in injunction dispute with waste company (and in parallel federal cases in Texas in which parish was sued by EPA) over move to transport and dispose of lead contaminated soil in landfill near Monroe, Louisiana. Tried to the bench in Monroe state court.
    • Representation of NORM handling company which obtained a permit for a transfer station in Avoyelles Parish. Parish voted to amend parish ordinances to exclusively target client’s facility. Firm obtained TRO in western district federal court based upon constitutional grounds (civil rights lawsuit).
    • Representation of several railroad defendants in matter, which ultimately was resolved in a series of court approved settlements in federal court in Baton Rouge. Served as court appointed Liaison Counsel for third-party defendants and later in the same capacity for CERCLA defendants. Case involved both tort claims under state law and CERCLA cost recovery claims.
    • Representation of defendant in tort/environmental contamination action involving claims by lessor that lessee contaminated site in Houma, Louisiana.
    • Representation of an insured of Lloyd’s of London in suit by landowners against owner/operator of adjacent gasoline terminal, alleging groundwater contamination.
