Blake Bailey has more than 30 years of experience in helping clients resolve complex commercial disputes in state courts, federal courts and before arbitration panels throughout Texas as well as in Arizona, California, Illinois, Indiana, Florida, Nevada, New Mexico, New York, Ohio and Utah.
Blake has represented clients in a broad range of matters including contract, easements and rights-of-way, director and officer liability, shareholder matters, employment practices, construction, civil and criminal antitrust, RICO, deceptive trade practices, protecting confidential information and trade secrets, covenants not to compete, franchise and distributor disputes, trademark infringement, professional liability, product liability and grand jury proceedings.
Blake leads Phelps' Dallas/Fort Worth litigation group and serves on the firm's Ethics Committee.
Experience
- Achieved dismissal of RICO case against multiple Texas health care providers in multimillion-dollar suit claiming fraudulent billing and providing unnecessary medical services in personal injury cases.
- Secured permanent injunction to stop infringement of major insurance marketplace’s trademarks by insurance adjuster, ending litigation from multiple suits filed by the adjuster seeking millions of dollars in damages.
- Lead counsel obtaining unanimous jury verdict rejecting plaintiff's wrongful termination claim.
- Lead counsel obtaining summary judgment dismissing professional liability claims against wholesale insurance broker.
- Lead counsel obtaining summary judgment dismissing copyright claims under Digital Millennium Copyright Act.
- Lead counsel obtaining summary judgment dismissing professional liability claims against insurance brokers in multiple cases.
