John McMackin is a Mississippi appellate lawyer who helps insurers, businesses and contractors resolve high-stakes appeals, trials, and complex disputes. A former judicial law clerk at the Supreme Court of Mississippi, the Fifth Circuit and the U.S. District Court for the Southern District of Mississippi, John draws on firsthand insight into judicial decision-making to develop focused arguments, preserve issues for appeal and position cases for effective appellate review. His appellate perspective also informs his work at the trial court level. In addition to litigating cases through trial, John advises clients on dispositive and post-trial motions, error preservation and other issues that can affect appellate review.
At trial and on appeal, John regularly represents insurers and insureds in coverage and defense disputes involving the duty to defend and indemnify, reservations of rights, waiver and estoppel and declaratory judgment actions. He also handles commercial, transportation and casualty claims.
His work for insurers and businesses frequently extends into commercial and construction disputes. John handles contract and business tort claims, restrictive covenants, arbitration and construction matters involving payment, liens, bonds, delays and defects. His experience also includes builder’s risk and CGL coverage disputes and litigation under 42 U.S.C. § 1983, Title VII and the Mississippi Tort Claims Act.
