    Sara Nau

    Counsel

    Areas Of Focus
    InsuranceLitigation

London Market insurers and domestic carriers turn to Sara for strategic advice about policy coverage when they receive insurance claims related to medical malpractice for hospitals and health providers. She also counsels insurers when they face product liability insurance claims for drugs, medical devices and dietary supplements.

Sara spent three months on secondment with a Lloyd’s syndicate as part of its claims team, where she gained first-hand insight into the pressures and priorities insurers face. Working directly alongside adjusters, she provided coverage and wording advice on a range of matters, with a particular focus on health care and medical malpractice risks. This experience sharpened her ability to deliver practical, business-minded counsel that aligns with how insurers evaluate claims, manage reserves and communicate with their clients.

When in litigation, she manages the case from inception to resolution, handling discovery, depositions, and mediations, as well as preparing motions to dismiss and/or for summary judgment. She also handles settlement negotiations and provides strategic analysis on resolution of claims. Her clients appreciate her ability to anticipate potential issues with a case and to recommend settlement when prudent. Her research and command of the issues help her steer clients through difficult negotiations, earning their trust.

    Experience

    • Provided wording advice to insurers to help them update policy exclusions and sublimited coverage for sexual misconduct and physical abuse on a medical professional liability/general liability policy form.
    • Obtained summary judgment against a party seeking reimbursement of a substantial amount of defense costs and settlement payment under client’s policy, based on the argument that “vendor’s endorsement” in the client’s policy was not triggered.
    • Assisted clients with a complex coverage dispute involving various policy towers and questions on whether multiple claims related to the alleged negligent credentialing of a doctor should be “batched” in one policy year.
    • Provided wording and coverage advice to insurers on Life Sciences/Products Liability policies that insure medical device and drug manufacturers.
