    Labor and Employment

    Both an advocate and counselor, Rebecca Sha uses her breadth of knowledge to guide clients through complex and sensitive matters inside the courtroom as well as within an institution.

    In her capacity as a trial lawyer, Rebecca helps clients resolve disputes, including wage and hour violations, employment discrimination, harassment, retaliation claims, commercial litigation, constitutional law, Title IX and student and faculty issues. She also advises and advocates for clients in several industries, including:

    • Education (Higher, Independent School, K-12)
    • Maritime
    • State and local entities
    • Nonprofits
    • Hospitality

    Skilled in always seeing the big picture in any dispute, Rebecca has obtained successful results on behalf of her clients whether through trying cases in court or administrative investigations and proceedings before the DOL, NLRB, EEOC and OCR. She also guides clients through alternative dispute resolution in arbitration and mediation. 

    Rebecca counsels clients on a range of labor and employment matters, including but not limited to the following:

    • Student, staff and faculty complaints
    • Student admissions
    • Tenure
    • Leave policy
    • Disability accommodations
    • Waivers and releases of claims
    • Classification of employees for the payment of minimum wage and overtime

    Rebecca is also a member of the firm's Diversity and Inclusion Committee.

    Prior to joining Phelps, Rebecca worked for a New Orleans law firm in commercial general litigation where she defended and advised clients in labor and employment disputes. During law school, she interned for the Honorable Chief Judge Brian A. Jackson of the United States District Court for the Middle District of Louisiana, clerked with the Equal Employment Opportunity Commission (EEOC), as well as externed at two offices of general counsel of higher educational institutions.

    Employment Law

    • Defended and obtained summary judgment for ADA/disability discrimination case concerning partial sight impairment which was upheld on appeal
    • Successfully defended company against FLSA collective action, including denial of conditional certification of a class
    • Successfully defended application for attorney’s fees and costs in connection with FLSA collective actions, including obtaining over 50% reduction in award
    • Defended maritime companies including in the California Supreme Court concerning exemption of maritime employees from overtime
    • Successfully obtained highly favorable settlement of a class action age discrimination lawsuit in connection with a reduction in force
    • Defended hospitality company against consolidated claims of race discrimination

    Education Law

    • Tried preliminary injunction proceeding on behalf of a school board in connection with a revocation of a charter
    • Successfully obtained early dismissal of claim by tenured professor claiming wrongful termination and violation of constitutional rights
    • Successfully obtained dismissal of OCR complaint concerning failure to provide student educational accommodations
    • Successfully obtained dismissal of EEOC complaint concerning failure to promote faculty to tenure on the basis of religious discrimination
    • Defended schools against claims of violation of student code of conduct and breach of contract
    • Defended universities and schools against claims of violation of Title IX

    Commercial Litigation

    • Successfully obtained dismissal of allegations of constitutional claims brought by an individual against the CEO of a national, non-profit, civil rights organization
