    Education

Educational institutions must confront thorny legal, regulatory and constitutional decisions that can have complex effects on their operations. We leverage a cross-practice team with deep experience in education law to develop proactive plans for tomorrow while quickly responding to legal challenges facing organizations today.

Educational institutions have to manage unforeseen and sometimes unprecedented issues while protecting employees and students and complying with state and federal regulations. At Phelps, we understand the unique and diverse concerns of educational institutions, as well as the particular culture of each. From student codes of conduct and data privacy concerns to Title IV and Title IX compliance and litigation, the industry requires a team that can span multiple practice areas with ease. Our group brings together lawyers across disciplines and offices to deliver the most efficient, effective results for our clients.

    Independent Schools

In the education industry, it is crucial to work with responsive legal counsel that can adapt to a shifting landscape while recognizing risks and trends in advance. School governance, student discipline and employment claims are just a few of the complex issues employers and decision-makers at independent schools continue to grapple with. Each school has developed its own ways to instill values, provide excellent education, and positively impact the community. Phelps works to understand these unique cultures and processes to handle issues and design policies that align with each school’s goals and address any reputational concerns.

    K-12 Institutions

Elementary and secondary institutions often find themselves on the front lines of emerging legal issues where guidance is unsettled or conflicting. Legal questions around cybersecurity, staffing and union concerns, and curriculum changes are still catching up to federal and state requirements, leaving schools subject to constantly evolving compliance requirements. Phelps’ team is well versed in helping schools navigate overlapping regulations and quickly implement changing guidance. And with an eye on developing cases and legislation, Phelps can help to modify or develop new procedures to stay ahead of industry shifts.

    Higher Education

The competitive higher education market adds another layer of consideration to the decisions facing these organizations. Phelps has the experience to guide higher education institutions through high-profile issues involving employment, discrimination, sexual misconduct and free speech, while anticipating the potential roadblocks or effects of each path forward. Our team offers comprehensive advice on the issues particularly affecting higher education, from employee training and proactive policy design to complaint resolution and courtroom representation.

Phelps knows the regulatory, transactional and litigatory issues faced by educational institutions. No matter the size of the organization or the scope of their employee base and community, we counsel our clients on complex, highly specific legal issues so that they can continue to deliver a quality education to their students and community while remaining in compliance. We represent a broad set of educational institutions, including:
