    Andrew Coffman helps individuals and businesses protect their intellectual property and guides professionals in highly regulated industries through administrative actions. Clients rely on his experience on both sides of the court to find practical paths forward through complex claims and disputes.

    Andrew focuses much of his practice on working with clients in the tech, health care and entertainment sectors. He represents software developers, record labels, recording artists, publishers and songwriters in copyright suits. He also advocates for health care clients in intellectual property cases and regulatory disputes.

    Before joining Phelps, Andrew served as the advisory attorney for Tennessee’s Controlled Substance Monitoring Database. He was the inaugural National Center for Justice and the Rule of Law Fellow, where he studied the intersection of existing law and the internet.

    Andrew often writes and speaks on emerging IP issues, recently publishing and presenting on topics such as NIL contracts, the CASE Act, and the intersection of IP and the First Amendment.

    Before joining Phelps, Andrew served as the advisory attorney for Tennessee’s Controlled Substance Monitoring Database. He was the inaugural National Center for Justice and the Rule of Law Fellow, where he studied the intersection of existing law and the internet.

    Experience

    • Secured permanent injunction to stop infringement of major insurance marketplace’s trademarks by insurance adjuster, ending litigation from multiple suits filed by the adjuster seeking millions of dollars in damages.
    • Successfully defended a health care system in a trademark claim made by a community health center operating under a similar trade name. During the discovery period, the Court granted a motion to dismiss and the case was settled within two weeks of the amended complaint being filed.
    • Obtained a verdict determining publisher owned a series of disputed musical compositions and was entitled to more than $2 million dollars in copyright infringement damages, an award that was affirmed on appeal. 
    • Secured grant of discretionary appeal in the Tennessee Supreme Court in a case of first impression involving application of Tennessee’s three dismissal procedural rule, resulting in a favorable decision for the client.
    • Represented a vacation brand in a series of Civil RICO, misappropriation of trade secrets, fraud, and intentional interference with business actions and defended the brand against counterclaims for defamation, including securing successful outcome for client on summary judgment in one case.
    • Successfully represented a software company in copyright infringement actions that arose out of a third-party bankruptcy proceeding, including an action related to the transfer of embedded software through the bankruptcy liquidation.
