    Drew Patty integrates his legal experience with commercial strategies to propel businesses in the medical, energy, insurance, financial and manufacturing sectors. His background in biochemistry and extensive patent practice enable him to bridge the gap between complex scientific concepts and practical, innovative business applications. He conveys the practical benefits of the intricate work of researchers, through the progression from experiments to salient results, while leveraging the nuances of intellectual property law to create valuable patent and other assets for clients in product manufacturing, distribution and service optimization.

    With a patent practice that spans the globe, Drew prepares and prosecutes:

      • U.S. and international patent and trademark applications
      • Secured loan transaction IP due diligence
      • U.S. copyright applications
      • Patent, trademark and software licensing
      • Joint development, software development and software-as-a-service subscription agreements

    Clients developing new brands, inventions or products turn to Drew to steer them through the process of monetizing innovation while also avoiding infringement. He guides clients in freedom-to-practice and validity opinions on patents and trademarks, strategic IP portfolio enforcement counseling, and international portfolio management.

    Advocating for both plaintiffs and defendants, Drew represents clients in patent infringement, trademark infringement, trade secret misappropriation and copyright infringement litigation. He also counsels clients in domain name disputes under the ICANN arbitration procedures.

    He appears before the U.S. Patent and Trademark Office’s Patent Trial and Appeal Board and its Trademark Trial and Appeal Board.

    Drew also leads the firm’s Artificial Intelligence working group, guiding clients through the rapid developments in machine learning technology that currently and are expected to impact their organizations. And he serves on the firm's Innovation Committee.

    As a member of the firm’s Cybersecurity practice group, Drew keeps clients updated on internet privacy and data privacy policies and requirements. He provides counsel on complex regulatory issues such as compliance with data transfer rules, including the GDPR/Privacy Shield requirements for U.S. businesses involved with processing or controlling personal information. Drew also advises clients who are negotiating and drafting cloud services, software licenses and other vendor contracts, keeping them informed on appropriate data security, privacy, cyber insurance and data management provisions.

    Drew has Native American ancestry and is a registered citizen of the Muscogee Creek tribe.

    Experience

    • Represented a public university foundation in chemical patent matters, including a patent interference adverse to a Nobel Prize winner in Chemistry.
    • Negotiated on behalf of a casino developer to secure a multimillion-dollar brand and celebrity rights license in connection with the development of a $200 million themed casino project.
    • Served as IP due diligence counsel for the lead lender to successfully close a $25 million round of financing for a biofuels industrial plant employing patented technology.
    • Achieved a favorable settlement for a national financial institution in federal litigation involving a software licensing dispute with one of the client's online banking system vendors.
    • Represents a major publicly traded specialty chemical company in patent matters involving approximately 700 patent applications worldwide.
